Who counts as the operator of a construction site?
The permit asks for the operators and the area of the site each one controls (Part 7.2.1) — a list of company names without their areas does not meet the clause.
Control is the test, not the contract
Where more than one company runs part of a site, the plan has to name each of them and say which area each controls. That mapping is what makes the rest of the plan enforceable — an inspection finding has to belong to somebody.
It is also the field most often filled in with a list of names and nothing else, which is why the generated plan puts a note next to it.
It changes during the job
When control of an area moves, the plan changes with it — within seven days, under Part 7.4.1.

- Sometimes, sometimes not, and in some states the permit puts the duty on the landowner or applicant expressly — Wisconsin is one. Read the clause on your state page.

- Texas SWPPP requirements — Texas requires the SWP3 to be developed and implemented by the primary operator; the permit contains no PE, CPESC or licensing language for preparation.
- Virginia SWPPP requirements — Virginia requires only that SWPPPs be prepared in accordance with good engineering practices; its certification classes apply to agency reviewers and inspectors, not to preparers.
- Arizona SWPPP requirements — Arizona requires a "qualified person", defined to include the operator's own employees as well as outside personnel.
